Bill Summary:
AB 1308 will help millions of Californians move on from their past records, and meet their full potential. Current law allows individuals to clear arrests that did not result in a conviction and convictions that are eligible for dismissal, but puts the burden on affected individuals to be aware of their eligibility and to retain an attorney to file the petition. These expensive and time consuming barriers to record relief continue the long history of unequal impact of the justice system on disadvantaged communities, and communities of color in particular. CA DOJ is already required to automate arrest and conviction relief for records starting in January 2021; this bill will extend that automated relief to records dating back to January 1, 1973.
