Bill Summary:
California passed the Racial Justice Act in 2020, which prohibits the state from seeking or obtaining a criminal conviction, or imposing a sentence, based on race, ethnicity, or national origin. The previous bill allows defendants to protect themselves from unjust bias in the criminal justice process in future cases. AB 256 will provide a mechanism for retroactive relief and justice from racially biased past convictions.
