Bill Summary:
Under current law, when a defendant is convicted of two separate offenses, the court is forced to impose a sentence for the offense carrying the longest potential term of imprisonment. This didn’t used to be the case only 25 years ago. AB518 will allow judges to once again use their discretion when sentencing. This is another step to reverse the tough on crime policies of the past that have often constrained judges, and contributed to the overpopulation of California prisons.
